Short Form Subdivisions (Lot Splits)

WHAT IS A SHORT FORM SUBDIVISION?

A short form subdivision, or lot-split is the process of legally dividing a lot of record into two or more tracts of land, and is required for any division of land resulting in tracts of five acres or less. 

Formal platting may be unnecessary in all instances.  An existing lot may be further split in the following situation:

  • It is owned by one party

  • No more than three lots will be created, including the parent tract

  • The property has not been divided in the previous twelve (12) months

  • There is legal access via an improved public or private right-of-way

  • Proposed lots are properly zoned and meet all requirements of City Code Chapter 122.

  • Proposed property lines will not create non-conformities

  • Fire apparatus has access to the property and fire suppression is available

  • Adequate required utilities are present

  • The proposal is approved by the Mustang Planning Commission.

 

HOW DO I APPLY FOR A LOT SPLIT? 

  1. Submit a completed application, include all required documents 

    • A deed of the original tract and the proposed tracts.

    • A certified survey 

    • All instruments for the dedication of required public easements and rights-of-way 

  2. Pay the filing fee, $75.00 

WHAT IS THE LOT SPLIT PROCESS? 

  1. Once all the required documents are submitted, the Community Development Director and the City Attorney review the application. 

  2. If everything is accurate the Community Development Director will schedule the Lot Split Application on the City Planning Commission's agenda and recommend approval or denial.

    • The Planning Commission meets on the Second (2nd) Tuesday of each month at 7:00 p.m., in the Mustang Municipal Building located at 1501 N MUSTANG RD.

  3. The application will go before the Planning Commission who have the final authority to approve or deny the application.
