Board of Adjustment

The Board of Adjustment regularly meets every second (2nd) Tuesday of the month.

The membership, duties and responsibilities of the board of adjustment ("BOA") are described in Article, II, Division 5 of the Mustang Code of Ordinances. 

Board membership consists of five members, four of which are directly appointed by city council. One member is appointed from the membership of the planning commission. 

The BOA has the power to hear and decide special exceptions to the zoning ordinance to allow a use, or a specifically designated element associated with a use, which is not permitted by right in a particular district because of potential adverse effect, but which, if controlled in the particular instance as to its relationship to the neighborhood and to the general welfare, may be permitted by the board of adjustment, where specifically authorized by this chapter, and in accordance with the substantive and procedural standards of this chapter.

The BOA may also issue zoning variances that are not contrary to the public interest, where owing to special conditions a literal enforcement of the provisions of the zoning ordinance will result in unnecessary hardship, and so that the spirit of the ordinance is observed and substantial justice done. It is also charged with deciding oil and/or gas applications or appeals.

All actions by the BOA must be preceded by Public Notice and a Public Hearing in accordance with the City Code.
